Terms of use

1. The service

AICommerce.ma offers courses, AI tools (product research, creatives, sales pages, advisor, copilot), order and delivery management through SKSystem, WhatsApp messaging through official providers and, where available, Meta ad campaign management. Some features are announced as "Soon" and are not yet provided.

2. Account and eligibility

• You must be an adult and use the platform for a commercial activity.
• The account is personal. You are responsible for keeping your password confidential and for any activity from your account, including by agents you add to it.
• Information you provide must be accurate and kept up to date, in particular the WhatsApp number of each boutique.

3. Boutiques

Each boutique has its own products, orders, pages, integrations and number. The number of boutiques depends on your plan. An additional boutique must have its own phone number, used for its delivery account.

4. Plans, payment and AI balance

• Plans and prices are shown in the panel. Payment is by bank transfer; the transfer declaration, with its proof, is checked by our team.
• A paid plan starts on the day our team validates the transfer and runs for the chosen duration. It is not extended by a running period.
• At the end of the period, without a validated renewal, the boutique falls back to the free plan. If it then exceeds that plan's limits, the tools are suspended until a new payment is validated; access to the dashboard, the subscription page and support is kept.
• AI generations are debited from a prepaid balance at the price shown before each generation. A generation refused by the provider or not produced is refunded to the balance. The balance is not refundable in cash, except for an error on our side.
• Prices may change; changes do not apply to periods already paid.

5. AI-generated content

• Copy, visuals, briefs and pages produced by the AI are proposals. You check them before publishing and you are responsible for them: accuracy, legality, no misleading advertising, respect of third-party rights.
• You hold the rights on results generated from your content, within what the model providers allow.
• You only give the AI content you have the right to use.

6. Sales pages and orders

Sales pages published from the platform are yours: you are the seller, responsible for the offer, the price, delivery, after-sales service and the processing of your customers' data. AICommerce is not a party to the sale. You undertake to inform your customers about the use of their data, including WhatsApp confirmation.

7. WhatsApp and advertising

• Messages sent to your customers go through official providers and are subject to Meta and WhatsApp Business policies. You only message people who agreed to be contacted.
• You use a number dedicated to your boutique and you are responsible for its quality (blocks, reports) and for the message fees charged by the provider or by Meta.
• When you connect an ad account, you remain the account holder, responsible for spend, content and compliance with Meta advertising rules.

8. SKSystem delivery

Parcels are shipped through an SKSystem account linked to your boutique. Delivery services are governed by SKSystem's terms; AICommerce transmits your orders and displays their statuses.

9. Acceptable use

• No unlawful, misleading, infringing, hateful content or content violating third-party rights.
• No attempt to access another boutique's data, bypass limits, abuse automation or disrupt the service.
• Courses and their materials are for your own use; reproduction or resale is prohibited.

10. Intellectual property

The platform, its courses, brands and code belong to Jokesigner or its partners. You keep ownership of your content and grant us the right to host and process it to provide the service.

11. Availability and support

We do our best to keep the service available and improve it. Interruptions may occur for maintenance or causes beyond our control. Support answers from the panel ("Questions & claims") and on WhatsApp during business hours.

12. Liability

The platform is provided as is. To the extent permitted by law, our total liability for the service is limited to the amounts you paid us over the last twelve months. We are not liable for business decisions taken on the basis of generated content, for loss of business, or for third-party services (Meta, WhatsApp, SKSystem, Google, AI providers).

13. Termination

You can close your account at any time through support or the "Delete your data" page. We may suspend or close an account for a serious breach of these terms, after notice where possible. Amounts already paid for the current period are not refunded in case of termination for breach.

14. Governing law

These terms are governed by Moroccan law. Any dispute is submitted to the competent courts of Morocco, after an attempt at amicable settlement.
